A subcontract agreement is our protection when something goes wrong. Don’t take it lightly.

 

Q: I want to start using a subcontract agreement with my subcontractors. Can I just download one from the internet?

A: Only if it’s from a reputable source and even then you need to check it out and amend it.

 

  1. The contract is there to protect us
    1. It outlines the relationship with our subs
    2. It provides the scope of work and responsibilities for each party
    3. It tells us what to do when something goes wrong – don’t leave this to the internet
  2. How can we find the right subcontract template
    1. There are some good sources on the internet like trades associations or AIA docs
    2. Hire an attorney to draft one
    3. Best scenario, find some on the internet to get an idea of what you want then get your attorney to create one similar that meets your needs and location
  3. Be sure you tailor each subcontract for the job at hand
    1. A subcontract agreement is not one size fits all, you need to adjust for the project
    2. Make sure you have the proper legal information like project name and location and subcontractor’s legal name
    3. Be sure all contracts include the following sections
      1. A detailed scope of work
      2. A schedule section outlining durations as well as dates
      3. A section listing all related contract documents
